Terms of Mailbox Service

These Terms of Mailbox Service (“Terms”) govern private mailbox (“PMB”) service provided by Mtn Postal (“Mail Service”), a Commercial Mail Receiving Agency (“CMRA”). These Terms may be updated from time to time. Updates apply prospectively and do not reduce prepaid service already purchased, unless required for legal/USPS compliance, safety, or fraud prevention.
1. Contract & Appointment
By purchasing mailbox service, completing your in-store paperwork, and completing USPS Form 1583 (which we will make available to the USPS), you appoint Mtn Postal as your agent to receive mail and packages addressed to your PMB for the period not to exceed that for which fees are paid in advance. You agree to check your mailbox regularly and/or make suitable arrangements in advance.
2. Lawful Use
You will not use your PMB or our services for unlawful, illegitimate, or fraudulent purposes, or for any purpose prohibited by USPS. Each individual or entity must complete a separate USPS Form 1583 to be authorized to receive mail or packages at this location.
3. Keys & Access
We provide mailbox keys for access during business hours. Keys remain our property and may not be duplicated or modified. Additional keys may be available for an additional fee. The relationship is bailment, not landlord/tenant.
4. Delivery by USPS
You release and absolve USPS and its representatives from liability for mail delivered to our facility. Collection, handling, distribution, or any additional services are separate transactions between you and Mail Service.
5. Delivery by Mail Service
Once we place your mail into your PMB, it is deemed delivered. We are not responsible for loss, theft, or damage after delivery to the PMB. We are not engaged in carrier delivery and cannot be responsible for carrier delays or damage in transit.
Notifications (texts/emails/calls/notes) about packages are provided as a courtesy and do not change delivery status or pickup readiness.
6. Authorized Collectors & Estate Requests
Possession of a key may be treated as evidence of authority to collect mail. If you authorize another person to collect mail, you are responsible for providing required identification and documentation.
In the event of death or incapacity, we require appropriate legal documentation (e.g., executor/trustee authority, court documents, or other proof) before releasing mail to any requested party.
7. Identification Requirements
Per USPS regulation, photo and address identification must be current and unexpired. You must provide updated identification if expired, and notify us of any change in permanent address with updated address identification.
8. Forwarding / Change of Address
We do not provide mail forwarding as part of mailbox service. USPS does not permit a Change of Address from a private mailbox (PMB). Mail delivered to our facility is considered delivered to you; any re-mailing or forwarding (if offered as a separate paid service) is a separate transaction.
9. Compliance Requests
You agree to use services in compliance with USPS regulations and all applicable laws. Requests for updated ID or required information may be delivered to your mailbox and/or sent electronically. Failure to promptly supply required information may result in cancellation without notice, refund, or forwarding.
10. Export / Re-mailing Authorization
If needed for export transactions, you authorize Mail Service to complete and file required declarations as your agent. You agree to provide true, accurate, and complete information for any re-mailing or export-related processing.
11. Confidentiality / Law Enforcement
Information you provide will be kept confidential and not knowingly disclosed without your consent except for law enforcement, postal operations, or legal compliance purposes.
12. Authorized Recipients
a) Residential
All mail recipients must complete a separate USPS Form 1583 and provide required documentation before we can accept mail on their behalf. Mail for non-registered individuals will be treated as undeliverable and returned to sender.
b) Commercial
All employees receiving mail for a registered company must be listed on USPS Form 1583 before we can accept mail on their behalf. Mail for non-registered companies/employees may be treated as undeliverable and returned to sender.
13. Restrictions & Large Packages
We are a small store. Oversized packages, excessive volume, or packages not picked up promptly may be assessed additional fees, refused, or result in service restrictions or termination with cause.
- No truck-line deliveries. Common carriers only.
- No hazardous or dangerous materials.
- We may refuse personal deliveries or deliveries without an established chain of custody.
14. Indemnity
You agree to indemnify and hold harmless Mtn Postal from claims, demands, and causes of action related to your use of our facilities or services.
15. Liability Limits
If Mtn Postal commits or fails to commit an act that disrupts service and you suffer a loss, our liability is limited to fees paid for service not yet received or $100, whichever is less. We are not liable for incidental or consequential damages.
16. Accountable Mail
We accept properly addressed accountable mail for registered recipients (e.g., certified, insured, registered, restricted). C.O.D. charges must be paid to Mail Service prior to acceptance of C.O.D. packages.
17. Standard Mail (Junk Mail)
You authorize Mtn Postal to discard or recycle USPS Standard Mail (commonly “junk mail” such as flyers, circulars, advertising, and catalogs). Standard Mail will not be scanned or placed in your mailbox.
18. Fees & Payment
Fees are due in advance. Notices may be placed in your mailbox and/or sent electronically; no other notice is required. We do not prorate fees and do not provide refunds for cancellation by Customer or termination with cause.
19. Addressing Format
Your address must conform to USPS requirements. Use only “PMB ####” or “# ####”. Do not use “suite,” “apt,” “dept,” or other physical designators.
20. End of Term / Do Not Forward
Upon conclusion or cancellation of mailbox service, USPS does not permit a Change of Address from a private mailbox. It is your responsibility to notify senders of your new address prior to termination. Mtn Postal does not forward mail without an active, paid mailbox agreement. This is a “Do Not Forward” arrangement.
21. Termination, Non-payment, and RTS (No Mail Holding)
If service ends for any reason (including non-payment, expiration, abandonment, or termination with cause), mail is not held and will be returned to sender (RTS) in accordance with USPS regulations. Mail will not be released without an active, paid mailbox service agreement.
22. Termination With Cause
Repeated failure to adhere to USPS or Mtn Postal requirements may result in termination with cause. Good cause includes, without limitation: failure to collect mail within a reasonable period, unreasonable volume, or offensive/abusive/disruptive behavior. Suspicious activity may be reported to USPIS and handled per instructions provided.
23. Auto-Renewal
Mailbox service may auto-renew at the then-current rate for the same term length, provided a valid payment method is on file. If you wish to cancel auto-renewal, you must notify Mail Service in writing before renewal processing.
24. California Notice — Business Use of a Private Mailbox
If your private mailbox is used for business purposes, California law requires compliance with applicable disclosure, advertising, unfair competition, and false advertising laws.
By using mailbox services and signing the in-store Mailbox Service Key Terms Acknowledgement, you acknowledge that you are required to disclose your actual home or business address on USPS Form 1583, to notify Mtn Postal (CRMA) of any changes, and you authorize Mtn Postal to act as your agent for service of process to receive legal documents, as required by California law.
Use of a private mailbox does not relieve the customer of any obligation to accurately identify the nature and location of a business in advertisements, solicitations, contracts, or other communications.
25. General Legal Terms
- Conflicts: If you signed a written mailbox agreement in-store, that signed agreement controls over this web page for that term, except where updates are required for legal/USPS compliance.
- Severability: If any part is unenforceable, the remainder remains in effect.
- Updates: We may update these Terms by posting a revised version to this page and updating the “Last Updated” date.
